1. General

1.1 Scope of Application

These General Terms and Conditions (“T&Cs”) apply to all products and services provided by Flight Levels GmbH (“Provider”). The Provider primarily offers services to business customers (B2B). However, in exceptional cases (B2C), mandatory consumer protection laws (especially under Austrian law) take precedence over any conflicting provisions in these T&Cs.

1.2 Online Dispute Resolution (for B2C)

Consumers in the European Union (EU) may submit complaints via the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
Flight Levels GmbH is not obliged to participate in a dispute settlement procedure before a consumer arbitration board.

1.3 Governing Law and Jurisdiction

These T&Cs are governed by the laws of the Republic of Austria.

1.4 Changes to the T&Cs

The Provider may modify these T&Cs at any time. Any changes will be communicated in text form (e.g., via email). If the customer does not object within 14 days after receiving the notification, the changes are deemed accepted. In case of a timely objection, the Provider may terminate the contractual relationship or continue it under the previous T&Cs.

1.5 Trademarks

“Flight Levels®”, “Flight Levels Coach®”, “Flight Levels Guide®”, and “Flight Levels Professional®” are registered trademarks of Flight Levels GmbH. Using these trademarks without the Provider’s prior written consent is prohibited and may lead to legal action.

2. Purchase and Use of Self-Paced Courses

2.1 Course Offerings

Self-paced courses typically include video materials and may include access to a Miro board for exercises. Some courses also offer discussion forums for interaction. The specific inclusions are listed on the respective course website.

2.2 Purchase of Self-Paced Courses

Purchasing self-paced courses is independent of their usage. One can buy one or more access codes and distribute these codes to other individuals. Once an access code is redeemed, the redeemer receives personal login credentials for the course. User login details must not be shared with third parties. Any violation will result in access revocation.

2.3 Access and Usage Terms

Course access is granted exclusively via individual, non-transferable credentials. Downloading, distributing, or using course materials outside the intended framework is prohibited. Presenting or showing the course to multiple persons is also not allowed.

2.4 Duration and Termination

Access lasts for one year from the date of redeeming the access code. After expiration, access can be extended via an active Flight Levels Practitioner Membership.

2.5 Updates

Any updates to the course content will be communicated through the discussion forum.

2.6 Payment Terms and Withdrawal

Payment is made via the Provider’s online shop. A refund is possible within 14 days of purchase by emailing hello@flightlevels.io. Refund processing may take up to 30 days.

2.7 Limitation of Liability (Self-Paced Courses)

The Provider is not liable for any damages or consequential damages arising from course usage, except in cases of gross negligence or willful misconduct (see also Section 7: Liability).

2.8 Copyright and Intellectual Property

All course materials are copyrighted by Flight Levels GmbH. Any use outside the course without explicit written consent of the Provider is strictly prohibited.

3. Purchasing Access Codes and Participating in Online Events

3.1 Organizer

Flight Levels GmbH, Rögergasse 36/16, 1090 Vienna, Austria (“Organizer”).

3.2 Nature of the Event

Online events will be hosted on platforms like Zoom, WELO.space, or Miro, with Circle used for text-based communication. Participants need to use Google Chrome and maintain a stable internet connection. Using a VPN may cause technical issues.

3.3 Disclaimer

The Organizer is not liable for technical problems beyond its control, including but not limited to internet outages or platform limitations. No liability is assumed for third-party content during the event.

3.4 Purchase of Access to the Event

The purchase of event access codes is separate from their usage. Once an access code is redeemed, the holder receives personal credentials. These credentials must not be shared.

3.5 Access and Usage Terms

Access is non-transferable, and any materials provided may not be downloaded, distributed, or used outside the event. Attending with multiple people under a single access is prohibited. Violations will result in immediate revocation of access.

3.6 Cancellation and Refund Policy

3.7 Code of Conduct

Professional and respectful behavior is required. Violations, such as personal attacks or discriminatory remarks, can lead to exclusion without refund.

3.8 Copyright and Use of Content

All rights to videos, presentations, and other materials remain with the Organizer. Unauthorized use by participants is not permitted.

3.9 Consent for Publication of Images and Names

By participating, attendees consent to the publication of photos, videos, and event reports including participant names and images on social media or other media, unless otherwise required by mandatory law or unless consent is withdrawn via hello@flightlevels.io.

3.10 Minimum Number of Participants

Some online events may require a minimum number of participants, as indicated in the specific event description. If this minimum is not reached, the Organizer reserves the right to cancel or reschedule the event. In case of cancellation, all fees will be fully refunded.

4. Purchasing Access Codes and Participating in In-Person Events

4.1 Event Description

In-person events are held live at a specified venue. Language is typically English unless stated otherwise on the event website.

4.2 Registration and Fees

Registration procedures, fees, and included services (e.g., meals) are detailed on the event website. Participants are responsible for their own travel and accommodation.

4.3 Purchase of Access

The purchase of event access codes is separate from their usage. Once an access code is redeemed, the assigned user gains the right to attend. Access credentials are non-transferable.

The Organizer is not liable for personal accidents, losses, or damages sustained during the event. Participants are advised to arrange their own insurance.

4.6 Health and Safety

All participants must comply with health and safety instructions, including any COVID-19-related measures.

4.7 Code of Conduct

Professional and respectful conduct is mandatory. The Organizer reserves the right to remove participants who behave inappropriately, without any refund.

4.8 Intellectual Property and Use of Content

All intellectual property rights in event materials belong to the Organizer. Commercial usage without prior written approval is prohibited.

4.9 Consent for Use of Photos and Videos

By attending, participants agree that the Organizer may use their names and images for promotional purposes in photos or videos taken during the event, unless consent is withdrawn by emailing hello@flightlevels.io.

4.10 Minimum Number of Participants

Certain in-person events may have a minimum participant requirement, noted in the event description. If not met, the Organizer may cancel or reschedule the event. In the event of a cancellation, all fees paid will be refunded in full.

5. Flight Levels Professional Program (FLPP)

5.1 Eligibility & Application

Admission requires an application and an interview. FLPP is primarily for B2B clients, but exceptions for individuals (B2C) may be granted at the Organizer’s discretion.

5.2 Candidate vs. Professional Status

Participants are “Flight Levels Professional Candidates” until:

  1. They successfully complete all FLPP requirements, and
  2. They hold an active Flight Levels Professional Membership.

Without both conditions met, no claim to the “Flight Levels Professional” title exists.

5.3 Structure & Tools

FLPP is conducted online (Zoom, Miro, Circle). A stable internet connection is required. No additional software licenses are necessary.

5.4 Attendance & Certification

Attendance at all sessions is mandatory. In cases of illness or emergencies, special arrangements may be offered at the sole discretion of Flight Levels GmbH. Certification is only granted upon full attendance and successful completion of program requirements.

5.5 Access & Membership

Upon payment, participants receive access to FLPP materials valid for one year from the program start date. Renewal requires an active Flight Levels Professional Membership.

5.6 Cancellation & Refund

5.7 No Guarantee & Disclaimer

Flight Levels GmbH does not guarantee any specific results, project success, or benefits from the FLPP. Liability for improper implementation remains with the participant, subject to the liability provisions in these T&Cs (see Section 7).

5.8 Confidentiality

Participants acknowledge that confidential business information may be shared. All participants agree to maintain strict confidentiality regarding any data or sensitive information disclosed. This obligation remains in effect even after program completion.

5.9 Code of Conduct

The Organizer’s Code of Conduct applies https://cm.flightlevels.io/code-of-conduct/. Violations may lead to removal without refund.

5.10 Use of Testimonials & Publications

Zoom recordings will not be published. Flight Levels GmbH reserves the right to publish testimonials and success stories using participants’ names and shared experiences for promotional purposes. Consent can be withdrawn at any time by emailing hello@flightlevels.io.

5.11 Minimum Number of Participants

Some FLPP sessions may require a minimum number of participants. If this minimum is not reached 30 days before the program starts, Flight Levels GmbH reserves the right to cancel or reschedule the FLPP. In the event of cancellation, all fees will be fully refunded.

6. B2B vs. B2C

The Provider’s offerings are generally intended for business clients (B2B). If, in exceptional cases, a private individual (B2C) purchases services, all mandatory consumer protection regulations (especially in Austrian law) will apply and take precedence over any conflicting clauses in these T&Cs.

7. Liability

7.1 General Principle

Flight Levels GmbH (including its legal representatives and vicarious agents) is liable without limitation in cases of willful misconduct or gross negligence.

7.2 Slight Negligence and Essential Contractual Obligations

In cases of slight negligence, the Provider is liable only for breaches of essential contractual obligations (cardinal duties) and only up to the typical, foreseeable damages. An essential contractual obligation is one whose fulfillment is necessary for the proper performance of the contract and on whose compliance the contractual partner regularly relies.

7.3 Exclusion of Further Liability

Beyond the damages regulated in Section 7.2, any further liability for slight negligence is excluded. This also applies to indirect or consequential damages such as lost profits or data loss.

Should any provision of these T&Cs be deemed invalid or unenforceable, the remaining provisions shall remain unaffected. Any issues not covered in these T&Cs shall be governed by applicable Austrian law.
